Course Description
Basic concepts: market competition, economic activity, undertaking. Anti-competitive agreements: Article 101 TFEU, horizontal and vertical agreements, block exemptions. Abuse of dominant position: Article 102 TFEU, exclusionary and exploitative abuses. Merger control: EU Merger Regulation, substantive assessment, efficiency defense, merger remedies. Enforcement system: Regulation 1/2003, judicial control, public and private enforcement. Public undertakings and state aid measures.
Intended Learning Outcomes
CILO-1: Students will be able to identify the role of competition law in the economic law of the European Union.
CILO-2: Students will be able to demonstrate how public and private enforcement of competition law interact in practice.
CILO-3: Students will be able to interpret the meaning of various EU legal documents related to competition law enforcement.
CILO-4: Students will be able to apply the legal concepts of anti-competitive agreement and abuse of dominant position in real life cases of anti-competitive conduct, and to distinguish between various phases of the merger control procedure.
