Course Description
This course is designed to combine the study of dispute resolution through adjudication and alternative dispute resolution in an international context. The course will examine legal issues arising in adjudication of international disputes through international, regional and domestic courts and tribunals. The course will specifically explore the role of international arbitration, arbitral institutions, enforcement of international awards and specialized arbitration. The international law governing mediation or conciliation and enforcement of settlement awards will receive a special focus. Finally, the course will assess emerging issues including online dispute resolution, specific international obligations of states and domestic law harmonization governing international disputes.
Intended Learning Outcomes
CILO-1: Students will be able to distinguish international adjudication and other alternative international dispute resolution methods.
CILO-2: Students will be able to assess the role and utility of specific international courts and tribunals in seeking the adjudication of international disputes.
CILO-3: Students will be able to appraise the advantage of international arbitration and select the relevant ad-hoc or institutional arbitration for effective resolution of international disputes.
CILO-4: Students will be able to prioritize the choice of mediation or conciliation with reference to relevant contemporary international norms before proceeding to seek adjudication.
CILO-5: Students will be able to prepare a dispute resolution strategy in the light of emerging developments like the Court-related Online Dispute Resolution (ODR) and international obligations and harmonization of domestic laws of specific jurisdictions.
