II. Constitutive principles of 'ius in re' - Internal principles; External principles.
III. Characteristics of the real property rights.
IV. The great forms of ordination of dominion.
V - In special, real property rights (ius in re) (definitive ordination of dominion). Types of ''ius in re''. Real property rights of use - Property. Community property. Joint ownership. Horizontal ownership. The usufruct. The use and habitation rights. Timesharing right. Superficial right - Real servitudes. Emphyteusis constituted before the new Civil Code of Macau. Intended Learning Outcomes
CILO-1: Students will: 1. Demonstrate and apply understanding of the legal principles of property law in Macau, and the nature and effect of different types of property rights and interests, including co-ownership, strata law and mortgages; 2. Comprehend the difference between Registered and Unregistered title; 3. Be able to demonstrate a detailed understanding of relevant statute law. Students will develop and consolidate the following skills: 1. Legal reasoning, argument and criticism, and problem solving; 2. Identify relevant legal issues and apply legal concepts, principles and rules; 3. Conduct legal research; 4. Present legal argument both orally and in written form; 5. Interpret statutory provisions.
